Work Injuries

When an employee is injured at work in North Carolina, they are generally limited and afforded the protection of benefits that the North Carolina Workers' Compensation Act provides. In other words, most of the time, the injured employee is not able to sue their employer for their damages like other cases.

Generally, if an employee is injured on the job, whether coming, going or on-site when the incident occurs, and regardless of fault or negligence on the part of the hurt worker (i.e. you were negligent) the employee is entitled to workers compensation benfits, including medical treatment and/or lost wages. Additionally, just because you may have had a prior injury, you are not disqualified from benefits if the accident aggravates or re-injures a past injury.

The North Carolina Workers' Compensation Act provides for certain benefits, including payment of the injured workers' medical expenses, prescription medications and the travel expenses to and from his or her medical treatment.

Also, if the injured employee's authorized treating physician diagnoses and testifies that the employee cannot work, then the employee is entitled to almost immediate payment of disability compensation for being unable to return to work. The amount of this disability compensation is usually 2/3 of that employee's average weekly wage.

Once an injured employee is able to successfully and completely return to his or her previous job, then that employee may be entitled to compensation for permanent disability if a competent physician or doctor believes that there is such a disability that will last indefinitely and limit the workers ability to earn wages in the future. However, if that person is not able to return to his previous job, a whole new set of issues arises.
